Wrongful Death

In Ohio, when the death of a person is caused by the wrongful act or neglect of another, then a “wrongful death” action may be pursued by the executor or administrator of the decedent’s estate for the benefit of the decedent’s surviving spouse, children, and parents, all of whom are rebuttably presumed to have suffered damages by reason of the wrongful death and for the benefit of the other next of kin of the decedent.

Wrongful death damages include funeral and burial expenses, and compensatory damages for loss of financial support, loss of services, loss of the society of the decedent including loss of companionship, consortium, care, assistance, attention, protection, advice, guidance, counsel, instruction, training, and education as well as loss of prospective inheritance to the decedent’s heirs at law at the time of the decedent’s death and mental anguish.
